1. Acceptance of Terms

By accessing, browsing, or using Haunted 365 and/or HR for Haunters (collectively, "the Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

Haunted 365 is a social community platform designed for haunt entertainment professionals, performers, creators, and enthusiasts to connect, share content, and engage with the haunt industry year-round.

HR for Haunters is a comprehensive human resources management system specifically designed for seasonal haunt businesses. This service includes employee management, scheduling, payroll processing, performance tracking, and compliance tools.

While Haunted 365 offers free community features, HR for Haunters is a premium subscription service requiring active membership. Organizations using HR for Haunters must invite their workforce to join their private workspace, requiring employees to create Haunted 365 accounts and provide necessary employment information.

These Terms constitute a legally binding agreement between you and Dreadful Damsels LLC ("Company," "we," "us," or "our"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services constitutes acceptance of any modifications.

2. User Eligibility, Age Requirements, and Account Requirements

2.1 Age Brackets and Registration

Haunted 365 uses age-based registration tiers in compliance with the Children's Online Privacy Protection Act (COPPA), the General Data Protection Regulation provisions for children (GDPR-K), and the UK Age Appropriate Design Code (AADC):

  • Under 13: Users under 13 years of age may not create accounts on Haunted 365. No personal information is collected from users who indicate they are under 13. Users under 13 may browse public attraction listings without an account.
  • Ages 13–15 (Teen Junior): Users aged 13–15 may create accounts only with verified parental or guardian consent. During registration, the minor must provide a birth year and a parent/guardian email address. The parent/guardian will receive a consent request email and must approve the account within 48 hours. Accounts not approved within this period are automatically deleted along with all associated data. Teen Junior accounts have restricted feature access including no messaging and limited community participation.
  • Ages 16–17 (Teen Senior): Users aged 16–17 may create accounts with verified parental or guardian consent following the same process as Teen Junior accounts. Teen Senior accounts may have expanded feature access (including limited messaging with mutual connections and employment features) if their parent/guardian enables expanded permissions through the Family Account dashboard.
  • 18 and older (Adult): Adults may create accounts through the standard registration process with full platform access.

2.2 Parental Consent Requirements

For users under 18, a parent or legal guardian must provide verifiable consent before the account becomes active. Consent is provided by clicking a unique confirmation link sent to the parent/guardian's email address. The consent link expires after 48 hours. If consent is not received within this period, the minor's account and all associated data are permanently and irrevocably deleted.

Parents and guardians may revoke consent at any time through the Family Account dashboard or by contacting us at [email protected]. Revoking consent will result in immediate deactivation and subsequent deletion of the minor's account and all associated data.

2.3 Family Accounts

Parents and guardians may create Family Accounts to manage their children's access. Family Accounts allow parents to control permission levels, review activity, and manage data for all linked minor accounts. Only verified adults (18+) may create and manage Family Accounts.

2.4 Feature Restrictions for Minors

Minor accounts are subject to age-appropriate safety restrictions. These restrictions are enforced automatically and cannot be bypassed. Adults may not initiate direct contact with minor accounts. All interactions involving minor accounts are subject to enhanced content moderation. Location sharing is disabled for all minor accounts unless explicitly enabled by a parent/guardian.

2.5 Turning 18

When a minor user turns 18, their account is automatically transitioned to an adult account with full platform access. The user will be notified of this transition and given the option to review and update their account settings.

2.6 Employment of Minors (HR for Haunters)

Haunts may use HR for Haunters to manage contractors, volunteers, and employees under 18 years of age, provided they comply with all applicable federal, state, and local laws regarding employment of minors, including but not limited to work permits, hour restrictions, safety requirements, and parental consent requirements. The attraction is solely responsible for ensuring legal compliance with all minor employment laws in their jurisdiction. Account administrators and managers for HR for Haunters must be at least 18 years old.

2.7 General Account Requirements

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Each user may maintain only one account. Creating multiple accounts, sharing accounts, or using automated systems to create accounts is prohibited.

3. License Grant and Restrictions

Haunted 365 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Haunted 365 for personal, non-commercial purposes in accordance with these Terms.

HR for Haunters License

Subject to active subscription and these Terms, we grant subscribing organizations a limited, non-exclusive, non-transferable, revocable license to use HR for Haunters for internal business operations related to workforce management.

Prohibited Uses

You may not:

  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated systems (bots, scrapers) to access or interact with the Services
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Services for any illegal, harmful, or fraudulent purpose
  • Interfere with or disrupt the Services or servers/networks connected to the Services
  • Resell, redistribute, or commercially exploit the Services without written permission
  • Remove, alter, or obscure any proprietary notices or branding
  • Use the Services to transmit viruses, malware, or other harmful code
  • Violate any applicable laws, regulations, or third-party rights

4. Community Guidelines and Content Standards

General Conduct

Haunted 365 fosters a respectful community for haunt industry professionals and enthusiasts. All users must:

  • Treat all community members with respect and dignity
  • Maintain civil discourse even during disagreements
  • Respect diverse perspectives and backgrounds within the community
  • Report violations of these guidelines through our reporting system
  • Cooperate with moderators and administrative staff

Content Standards

Content must be appropriate for industry context:

  • Prohibited Real Content: Real violence, gore, self-harm, or content promoting actual harm is strictly forbidden
  • Performance vs. Actual Harm: Haunt entertainment is a performance art built on consent. Content that celebrates or encourages actual harm to visitors or performers, or uses the haunt aesthetic to mask genuine threatening behavior, is not permitted
  • Consent Boundary: The visitor chose to be there. Content or behavior that targets individuals with intent to frighten outside a performance context violates the foundation of what haunt entertainment is
  • Intellectual Property: Respect copyrights, trademarks, and proprietary rights of others
  • Privacy: Do not share personal information of others without consent
  • Spam and Solicitation: Excessive promotional content, spam, or unauthorized commercial activity is prohibited

Prohibited Conduct

  • Harassment, bullying, or threatening behavior
  • Hate speech, discrimination, or content targeting individuals based on protected characteristics
  • Sharing of real graphic violence, self-harm, or illegal content
  • Impersonation of others or creation of misleading profiles
  • Doxxing or sharing personal information without consent
  • Coordinated harassment or brigading
  • Sexual content involving minors or non-consensual intimate content
  • Promotion of illegal activities or dangerous behaviors

Enforcement

Violations may result in content removal, account warnings, temporary suspensions, or permanent bans. We reserve the right to take immediate action for severe violations. Repeated violations will result in escalating consequences.

5. User Content and Intellectual Property

Content Ownership

You retain ownership of content you create and post to the Services ("User Content"). However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license (with right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in connection with operating and providing the Services.

Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

  • You own or have necessary rights to all User Content you post
  • Your User Content does not violate these Terms or applicable laws
  • Your User Content does not infringe upon rights of third parties
  • Your User Content is accurate and not misleading

Content Moderation

We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable. We may use automated systems and human review for content moderation.

6. HR Specific Terms

Employment Data Processing

HR for Haunters processes sensitive employment data including personal information, payroll data, performance records, and other HR-related information. By using HR for Haunters, organizations acknowledge and agree that:

  • They have authority to provide employee data to our system
  • They will obtain necessary consents from employees for data processing
  • They will comply with applicable employment and privacy laws
  • They are responsible for accuracy of employment data provided

Compliance and Legal Requirements

Organizations using HR for Haunters remain responsible for compliance with all applicable employment laws, including but not limited to wage and hour laws, anti-discrimination laws, workplace safety regulations, and tax obligations. Our Services are tools to assist with compliance but do not constitute legal advice.

Data Security and Backup

We implement industry-standard security measures to protect HR data. However, organizations are responsible for maintaining their own data backups and implementing appropriate internal security measures. We recommend regular data exports and secure handling of sensitive information.

Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the Services. Organizations should have contingency plans for payroll and HR operations during service outages.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

For HR for Haunters users, additional data protection measures apply to employment-related information as outlined in our Privacy Policy and applicable employment privacy laws.

8. Disclaimers and Limitations of Liability

Service Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. We disclaim all liability for any harm resulting from use of the Services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DREADFUL DAMSELS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

HR Services Disclaimer

Haunted 365 and HR for Haunters are software tools and do not constitute legal, tax, or HR consulting advice. Organizations remain solely responsible for compliance with employment laws and regulations. We recommend consulting with qualified professionals for legal and tax matters.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dreadful Damsels LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your User Content or any content you post
  • Your violation of any third-party rights
  • Your employment practices or HR decisions

10. Termination

Termination by Us

We may terminate or suspend your account and access to the Services at any time, with or without notice, for any reason, including violation of these Terms, illegal activity, or harm to other users or our business.

Termination by You

You may terminate your account at any time by following the account deletion process in your settings. For HR for Haunters subscriptions, cancellation terms are governed by your subscription agreement.

Effect of Termination

Upon termination, your right to use the Services will cease immediately. We may retain certain information as required by law or for legitimate business purposes. HR data will be handled according to our data retention policies and applicable employment laws.

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or the Services will be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court. The arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules.

Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

12. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and us regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign these Terms or your account without our written consent. We may assign these Terms without restriction.

Updates to Terms

We may update these Terms from time to time. We will notify users of material changes via email or platform notification. Continued use of the Services after changes constitutes acceptance of the updated Terms.
